Days
To Amaze Terms and Conditions - Please read Definitions "Experience" means the experience purchased by You against
which the Voucher can be redeemed as detailed in the Information Page; "Information Page" means the web page on the Site
informing You of the precise details of a specific Experience prior to
purchase; "Intellectual Property Rights" means rights owned by
Days To Amaze such as copyright, patents and trade marks and similar rights
owned by Days To Amaze anywhere in the world; "Recipient" means the individual who undertakes the
Experience whether you or someone you purchase a Voucher on behalf of; "Site" means www.daystoamaze.co.uk; "Supplier" means the third party Supplier of the
Experience; "Voucher" means the Voucher purchased by You through
the Site; "You" or "Your" means the person or
persons who purchase the Voucher through the Site;
Ordering
A Voucher-
When you purchase an Experience You will be sent a Voucher (unless stated)
which can be redeemed against your chosen day. When the Recipient wishes to
redeem the Voucher please call the booking centre (telephone number: 0871 230
1008) and we will make the necessary arrangements for the Recipient's
Experience. Please note that All Experiences are subject to seasonal
availability and booking limits. The Experience for which a Voucher has been
purchased must be undertaken by the Recipient prior to the expiry date stated
on the Voucher. As a result we may not be able to accommodate the Recipient's
booking on the Recipient's chosen date or venue. Some Experiences must be taken
within certain periods of the 12 months validity period as stated in the
relevant Information Page.
Unless otherwise
stated on the Site or on the Voucher, all Vouchers are valid for 12 months
from date of purchase.
Expiry dates will be
clearly marked on the Voucher. If you cannot find or are unsure of the
date please contact the booking centre. A voucher will be deemed to be
invalid if it is out of date (the validity date is clearly stated on the
gift voucher).
Vouchers can be
exchanged for another Experience, only once, providing the Voucher is
still valid and you or the Recipient pays any additional cost. To change
vouchers there may be an administration charge. For voucher changes please
contact one of our customer service advisors. If the exchange is for a
lower value Experience then the difference will be held in a credit
account for a maximum of 10 months from the date the original Voucher was
purchased. If the amount is not redeemed against an Experience during this
period then all monies will be forfeited.
Your voucher is
extremely important and you will need to take it with you on the day of
your booked experience. If you lose your voucher and require a replacement
voucher, there is an administration charge of £25.
Vouchers cannot be
exchanged for cash.
Only original
Vouchers will be accepted - no photocopies.
Please note once
your experience has been booked with a supplier it is final and cannot be
changed for any reason. (For this reason we offer the cancellation waiver
cover incase you are ill or breakdown on the way to the venue)
By purchasing a
voucher or undertaking the Experience, the Recipient agrees to be bound by
these terms and conditions.
Open
Vouchers the selection advertised at the time the open Voucher is
purchased may change from time to time. You should check if the selection of
Experiences relating to the open Voucher scheme has changed before seeking to
arrange an Experience.
Postage:
All
vouchers are normally posted out by first class mail (this delivery is to the
UK mainland only), please allow seven days for delivery during peak postal
times. If your order is placed before 3.pm you can choose & pay for special
next day delivery and your order will be posted on the day of purchase. This is
not an option on Fridays as next day delivery cannot be guaranteed on a
Saturday, if you opt for special delivery on a Friday it can only be guaranteed
for delivery on Monday. In all delivery cases Days to Amaze cannot be held
responsible for failure or delay of delivery as we use the Royal Mail postal
service and can only assume that they will fulfill their agreement as stated in
their documentation. Please note there will be no dispatch or delivery on UK
bank holidays and weekends. Restrictions
Many of our Experiences have height, age, weight and health restrictions
related to them. We have outlined these on the Information Pages. They are
there to make the Experiences safe for all participants. It is your
responsibility to advise the booking centre when purchasing the Voucher if
these apply to yourself. We reserve the right to refuse participation in any of
our Experiences if customers have failed to inform us of any conditions that
would make participation in the Experience dangerous for themselves or any
other party.
With certain Experiences the Recipient may be required to sign a disclaimer,
produce a medical certificate or complete a medical questionnaire by completing
such documents you warrant that the person/ people undertaking the Experience
are sufficiently mentally and/or physically fit enough to safely undertake such
Experience. The booking centre will be happy to advise the Recipient if they
require further clarification. Days to Amaze or the Supplier may refuse to accept
an individual booking if they believe the Recipient is not physically or
mentally fit enough to undertake the Experience. Weather
The Recipient should contact the Supplier prior to departure to check the
likelihood of cancellation due to weather. Telephone numbers will be provided
with your pack. Refund and Cancellation Days to Amaze reserves the right to re-schedule or cancel any
experience arranged by Days to Amaze. Days to Amaze will not reimburse Vouchers
holders for traveling and other related expenses caused by cancellation due to
adverse weather. You may cancel a purchase of a Voucher within 7 days of
purchase and Days to Amaze shall refund the monies paid for the Voucher to You.
All refunds will incur a £25 or 20% (whichever is greater) administration
charge. How to cancel To cancel you can email fax us, or write to us within 7 working
days of purchase of Your Voucher, quoting Your Voucher number. You must not use
the Voucher and take reasonable care of it. Vouchers may be returned to our

reserves the right to charge a cancellation fee, the amount of which shall vary
according to the relevant Experience. Venues
Where possible we will aim to accommodate Your Experience at Your chosen venue.
However at certain times, certain venues or vehicles maybe withdrawn or
cancelled by the Supplier of the Experience. Where this occurs we will offer
you or the Recipient an alternative venue or exchange your Experience for one
of a similar value. Suppliers Days to Amaze is a booking agent only and is not responsible for
the management or delivery of any of the Experiences; these are managed through
our Suppliers. Days to Amaze do not accept responsibility or liability for any
loss, injury or negligence caused by the Supplier. Liability (if You are a business) In no event shall Days to Amaze be liable to You or to any other
person or entity in any manner (including negligence) for
any economic loss of
whatever nature (whether or not such loss or damage was foreseen, direct,
foreseeable, known or otherwise), including loss of anticipated profits,
loss of actual profits (direct or indirect), loss of anticipated savings,
loss of business, or for any indirect, special or consequential loss or
damage arising out of the use of or inability to use the Site, or any
information, provided on the Site, via a link, or downloaded from the Site
or any delay of such information or service even if Days to Amaze (or its
authorized representative) has been advised of the possibility of such
damages; or
Any claim
attributable to errors, omissions, or other inaccuracies in the Site
and/or materials or information downloaded through the Site or via a link.
Nothing
in the above purports to limit Days to Amaze liability for death or person
injury caused by its negligence or for fraudulent misrepresentation. The Site By using the Site You agree that this limitation will apply to
all services, content, goods or services available through the Site. In the
event that the applicable law does not allow the limitation or exclusion of
liability or damages You agree that in no event shall Days to Amaze total
liability to You for all damages, losses and causes of action of any kind
exceed the amount, if any, You have paid Days to Amaze for a Voucher or
services purchased from the Site.
Days to Amaze uses reasonable skill and care in developing this Site but does
not give any warranty as to its accuracy, availability or reliability nor does
Days to Amaze guarantee that the functions contained in the Site will be uninterrupted
or error-free, that this Site or its server will be free of viruses or other
harmful components, or that defects will be corrected even if Days to Amaze is
aware of them. Intellectual Property Rights The Intellectual Property Rights contained within this Site are
owned by Days to Amaze or any other parties that have licensed their material
to Days to Amaze. All rights not expressly granted are reserved. You may
download, store and use the contents of the Site for Your own personal use. You
may not modify, republish, upload, post, transmit, distribute or otherwise make
the material contained within the Site (including but not limited to the text
and graphics, code and/or software) available to any other party or make the
same available on any website, on-line service or bulletin board of Your own or
any other party or make the same available in hard copy or on any other media
without Days to Amaze express prior written consent.
You agree to indemnify, defend and hold harmless Days to Amaze for any and all
unauthorized uses you may make of any material contained on the Site. You
acknowledge the unauthorized use of the contents could cause irreparable harm
to Days to Amaze and that, in the event of an unauthorized use, Days to Amaze
shall be entitled to an injunction in addition to any other remedies available
at law or in equity, Days to Amaze provides the Site and its contents on an
"as is" basis and makes no representations or warranties of any kind,
express or implied, with respect to the Site or its operation, contents,
products or services. Insurance Some of our Experiences have an element of risk attached to
them. In some instances you will be required to sign a disclaimer before
participating, and could be offered extra insurance on the day. If you have any
insurance queries please give our customer service advisors a call and they
will answer your queries.
Please be advised that Days to Amaze are not responsible for any claims arising
from death, personal injury which does not arise as a result of Days to Amaze
cancellation whilst participating in an Experience. We would advise all
Recipients to take out insurance against these before participating. Description and Images Where possible we have used images of the actual Experience on
the Site. However, because of the varied locations used this may not be actual
picture of Your Experience but a similar one. Days to Amaze has made reasonable
EndeavourÕs to check accuracy of descriptions and images provided by our
Suppliers. Beyond this the descriptions and images contained in the Site are
out of Days to Amaze control. Complaints As we are committed to on going quality and service improvement,
we welcome your comments and feedback on Your Experience. If in the unlikely
event of you experiencing a problem, please initially take this up with the
Supplier on the day, so that if possible they can attempt to rectify the
problem immediately. Privacy and Security We may also contact you in respect of any promotions We are
offering to customers and/or marketing events. If you wish to opt out please
let us know. to receive details of any of Our future promotions or marketing
events Severability of Clauses Each clause and sub-clause to the Days to Amaze Terms should be
construed independently from every other clause in the Days to Amaze Terms to
the effect that the validity or invalidity of one clause or sub-clause shall
not effect the validity of the remainder of the Days to Amaze Terms. Law and Jurisdiction The Days to Amaze Terms are governed by and will be interpreted
in accordance with English Law and any disputes relating to the Days to Amaze
Terms will be exclusively subject to the jurisdiction of the English courts.
